Terms and Conditions

Article 1 - General

These General Terms and Conditions apply to all use of the website BYENTI.com (website) and to all offers and quotations from ENTI and all agreements made between you and BYENTI.com.

Article 2 - Offers

2.1 All offers on the website are non-binding unless expressly stated otherwise. Offers do not automatically apply to repeat orders.

2.2 BYENTI.com cannot be held to its offers if you could reasonably understand that the offer contains an obvious mistake or error.

2.3 The prices listed on the Website include VAT. A contribution to the shipping costs will be separately mentioned to you prior to ordering. This contribution may depend on the order size. The shipping cost contribution is not refunded upon return shipment.

Article 3 - Data

3.1 You must ensure that your data, including but not limited to your email address, address details, and bank account number, are complete, correct, and up-to-date. You also guarantee that you are legally authorized to use the website in any way.

3.2 BYENTI.com guarantees that all your data will be treated with the utmost care and that this data will not be passed on, resold, or otherwise made available to third parties without your prior consent.

3.3 BYENTI.com processes your data and includes it in its file to fulfill its obligations under the agreement concluded with you and/or to process your application. Additionally, your email address may be used to keep you informed about certain products and services that may be attractive to you unless you have not given permission for this.

3.4 You can always view and, if necessary, change your data on the Website.

Article 4 - Conclusion of the Agreement

4.1 The agreement is concluded through the receipt of your order by BYENTI.com.

4.2 Modification of an agreement is only possible if explicitly accepted by BYENTI.com.

4.3 Cancellation is only possible within 15 minutes after placing an order, within our office hours from 09:00-18:00.

Article 5 - Delivery

5.1 The order will be delivered to your home unless you have indicated on the Website that you will pick up the order yourself or that the order should be delivered to another delivery address. The delivery period is a maximum of 5 days unless otherwise indicated. We only ship from Monday to Thursday. No packages are sent on Fridays and weekends. During new collection launches or holidays, delivery time is longer than usual!

5.2 You are obliged to take delivery of the purchased products at the moment they are made available to you.

5.3 If you refuse the acceptance or fail to provide the necessary information or instructions for delivery, the products intended for delivery will be stored at your risk and expense.

5.4 If you have provided an incorrect address for delivery, the additional shipping costs are at your expense.

5.5 If the maximum delivery time of 10 working days is exceeded, you have the right to cancel the agreement free of charge, only valid if it is not a pre-order or if the data is incorrect. For this, you must send an email, fax, or letter to BYENTI.com. Any payments will be returned to you within 10 working days (except on holidays) after notification.

Article 6 - Risk During Transport

During the transport of the products, BYENTI.com does not bear the risk in case of damage, theft, or loss of the products. This risk transfers to you upon delivery of the products.

Article 7 - Reflection Period

7.1 You have the right to cancel the agreement without giving reasons within 14 days after receiving the product. BYENTI.com will refund the purchase amount within 14 working days after receiving the returned product, provided that the product is undamaged, unworn, unwashed, or otherwise clearly unused or processed and is accompanied by the original packaging and (info) cards.

7.2 The costs for returning the product are at your own expense.

7.2.1 Returns are registered with our partner Returnless. An order is only received by us once you receive the email with ‘Refund’. It is important to keep track of the Track & Trace.

7.3 Beauty products, swimwear, lingerie, and scarves are not returned by BYENTI.COM for hygiene reasons.

Article 8 - Warranties

8.1 BYENTI.com guarantees that the products to be delivered meet the specifications stated on the Website.

8.2 You must inspect the delivered product at the time of delivery, but in any case, as soon as possible. You should examine whether the quality and quantity of the delivered goods correspond to what was agreed upon or at least meet the requirements that are customary in normal (trade) traffic.

8.3 BYENTI.com is not responsible for items after they have been worn, washed, or if the fabric starts to pill (fluff). If you do not like the fabric upon receipt, you must return it within the return period with the price tag and original packaging.

Linen items must be carefully washed by hand in cold water. They should never be put in the dryer after being washed. After an item has been washed, we are no longer responsible.

8.4 BYENTI.COM is also not responsible for any color differences between the webshop photos and reality. As we work with different types of daylight, studio lights, and professional cameras, colors may vary.

Article 9 - Retention of Title

BYENTI.com remains the full owner of the delivered product until the purchase price is fully paid.

Article 10 - Payment

10.1 When concluding the agreement, you determine how the payment will be made. For example, you can choose to pay by credit card or transfer to the account.

10.2 BYENTI.com will only deliver the product once payment has been received. This applies to all payments. Sofort banking has a processing time of two weeks, the order will be shipped once we have received the payment.

Article 11 - Collection Costs

If you fail to meet your payment obligations, BYENTI.com may not only claim the statutory interest on the amount due but also all reasonable costs incurred by BYENTI.com to obtain its claim out of court. The collection costs are in any case set at 15% of the principal amount; if BYENTI.com can prove that it has had to incur higher costs, these are also eligible for reimbursement.

Article 12 - Intellectual Property Rights

12.1 The (intellectual property) rights relating to the Website, including the rights to the texts, images, design, databases, photos, and other (static and/or moving) images, formats, software, brands (including domain names), and other materials, are vested in BYENTI.com, its licensors, the manufacturers of the relevant products, and/or third parties with whom BYENTI.com is not affiliated.

12.2 You may not make available to third parties and/or reproduce (parts of) the Website other than by downloading and viewing them on one computer and/or printing one hard copy.

12.3 You may not make changes to the delivered products unless the nature of the delivered products dictates otherwise or has been agreed in writing.

12.4 You may only create a hyperlink to the Website if this is done for informational purposes. Placing a hyperlink for another purpose, such as a commercial one, is therefore prohibited.

Article 13 - Liability

13.1 If products delivered by BYENTI.com are defective, BYENTI.com's liability towards you is limited to what is arranged in these General Terms and Conditions under Article 9 (Warranties).

13.2 BYENTI.com's liability for direct or indirect damage is in any case always limited to an amount equal to the purchase price of the defective product unless the damage is due to intent and/or gross negligence, or improper or inappropriate use by yourself.

13.3 BYENTI.com hereby excludes all liability for any damage whatsoever, direct and/or indirect, in any way caused by and/or resulting from the inability to use the Website, the fact that certain information on the Website is incorrect, incomplete, or not up-to-date, and the unlawful use of BYENTI.com's systems, including the Website, by a third party.

13.4 Various programs, stars, and magazines are mentioned on the Website. You should realize that BYENTI.com is an independent party. BYENTI.com is in no way, commercially or otherwise, affiliated with these programs, stars, and/or magazines. BYENTI.com has no control over the content of these programs and magazines or the behavior of the stars and cannot, therefore, be held liable for this.

13.5 The limitations of liability for direct and/or indirect damage included in these general terms and conditions do not apply if the damage is due to intent or gross negligence by BYENTI.com or its subordinates.

Article 14 - Force Majeure

Parties are not obliged to fulfill any obligation if they are prevented from doing so due to a circumstance that cannot be attributed to their fault and is not for their account under the law, a legal act, or generally accepted views.

Article 15 - References

The Website may contain references (e.g., through a hyperlink, banner, or button) to third-party websites. BYENTI.com has no control over these websites. BYENTI.com is not responsible for the content of these websites.

Article 16 - Miscellaneous

16.1 Any deviations from these general terms and conditions can only be agreed upon in writing. No rights can be derived from such deviations concerning later legal relationships.

16.2 The administration of BYENTI.com serves as evidence of the requests and/or orders you have made, subject to proof to the contrary. You acknowledge that electronic communication can serve as proof.
